10 Princípios do Condomínio da Terra

1. Temos de encarar a crise ambiental mundial, não como um problema do ambiente, mas como um problema da Comunidade dos Homens.

2. Para resolver a crise ambiental mundial, temos de resolver o problema jurídico da coordenação duma multitude de soberanias (Estados) exercidas sobre um bem materialmente indiviso (Terra), conformado por componentes insusceptíveis de divisão jurídica, mas dos quais todas as soberanias são funcionalmente dependentes.

3. Só na definição e prossecução do interesse comum (Terra), será possível continuar a garantir, a cada Estado, os seus direitos - sob pena de estes brevemente deixarem de ter objecto.

4. Um projecto Condomínio da Terra tem que distinguir as fracções estaduais das partes comuns: cada condómino é soberano dentro do seu território e, ao mesmo tempo, detentor de uma soberania partilhada das partes comuns do planeta.

5. As partes comuns são constituídas pelas partes que, de um ponto de vista ambiental, são:

a) necessariamente comuns (a Atmosfera e Hidrosfera), e 

b) presumidamente comuns (a Biodiversidade).

6. Existirá um regulamento do Condomínio da Terra que disciplina o uso, fruição e conservação das partes comuns, e uma Administração que será eleita em Assembleia de Condóminos (Estados).

7. Existe um direito/dever igual per capita no uso/conservação dos bens comuns; logo a votação relativa de cada condómino deverá ser aferida em função do número de habitantes de cada soberania.

8. Cada condómino comparticipará nas despesas necessárias à conservação ou fruição das partes comuns, de forma equitativa, em função do número de habitantes ou do uso efectivamente realizado de partes comuns, quando este for determinável, no sentido de garantir a coincidência entre o óptimo social e o óptimo ecológico.

9. Competirá ao Administrador do Condomínio receber todas as verbas provenientes dos Condóminos e promover projectos de conservação e melhoramento das partes comuns, bem como, compensar todos os condóminos que no seio dos seus estados contribuam para a sua manutenção e melhoramento.

10. Compete ao Condomínio da Terra descobrir formas de compatibilizar os sistemas jurídico e económico com o Sistema Natural Terrestre.
